1. Who we are and how to contact us
KAVODA TV is operated by KAVODA LTD (“KAVODA”, “we”, “us”), a private limited company registered in England and Wales under company number 14647624. Our registered office is 29 Queensbridge Drive, Ramsgate, Kent, CT11 9TU, United Kingdom.
You can contact us by email at support@kavoda.tv or by post at the address above. We will normally contact you using the email address on your account, or with a notice inside the app.
2. These terms and when they apply
These terms are the agreement between you and KAVODA for the KAVODA TV service: the KAVODA TV app on Roku devices, the website at kavoda.tv, the sign-in pages we host for the app, the emails we send you, and anything else we say these terms apply to. We call all of this “the Service”.
You accept these terms when you press Agree and continue in the app, create an account, buy a subscription, or otherwise use the Service. If you do not agree to them, please do not use the Service.
Our Privacy Policy explains how we handle personal data. Please read it together with these terms.
The version number and effective date are shown at the top of this page. The app shows you which version you accepted (Settings → Terms of Use), and we keep earlier versions available on request.
3. Who can use KAVODA TV
- Age. You must be at least 13 years old to use the Service. We do not knowingly let anyone younger use it. If you are between 13 and 17, a parent or guardian must read these terms, agree to them on your behalf, and take responsibility for your use of the Service.
- Date of birth. When we ask for your date of birth, give it accurately. We use it to apply age ratings: some series carry ratings up to 18 and are hidden or locked for younger viewers. Entering a false date of birth to see restricted content is a breach of these terms.
- Where the Service is offered. KAVODA TV is offered in the United States and the United Kingdom. It may not work, and content may not be available, elsewhere. We use your network location to apply this. You must not use a VPN, proxy or similar tool to make the Service think you are somewhere you are not.
- Your local laws. You are responsible for complying with the laws that apply to you where you use the Service.
4. Your account
You can start watching without an account. Each series has a free opening run; to carry on past it you create a free KAVODA account. You can sign in with a link or code we email you, with an email address and password, or by scanning a code on your phone. With your permission on the device, we can pre-fill the email address on your Roku account to save you typing it.
- One account per person. Keep the information on it accurate and up to date.
- Keep it secure. Sign-in links and codes are for you alone; each works once and expires within minutes. Keep your password private. You are responsible for what happens on your account unless it has been compromised through no fault of yours, in which case tell us at support@kavoda.tv as soon as you can.
- Your history travels with you. When you sign in on a device you had been using without an account, the viewing history, resume positions and My List from that device join your account.
- Suspension and closure. We may suspend or close an account that breaks these terms, is used fraudulently, or where the law requires it. We will tell you why unless the law prevents us.
- Deleting your account. You can delete your account at any time in the app (Settings → Delete account). Deleting your account does not cancel a KAVODA Plus subscription — that is cancelled in your Roku account (see section 6). What happens to your data is described in the Privacy Policy.
5. Free viewing and advertising
The free tier of KAVODA TV is paid for by advertising. You will see ad breaks between episodes and sometimes before or during them. How often ads appear may change.
Ads are delivered by us and by third-party advertising partners, including through Roku’s advertising platform. Advertisers are responsible for their own products and claims; we do not endorse them, and anything you buy from an advertiser is between you and them. The Privacy Policy explains what data is used to deliver ads and how to limit it on your Roku.
You must not block, remove or interfere with ads, or use tools that do. If you would rather watch without ad breaks, KAVODA Plus is available.
6. KAVODA Plus (the ad-free subscription)
KAVODA Plus is an optional monthly subscription that removes the ad breaks on KAVODA TV.
- Buying it. KAVODA Plus is sold inside the app through Roku Pay. The price (including any taxes Roku shows) and the renewal terms are displayed before you confirm. Roku charges the payment method on your Roku account, under Roku’s own terms. We never see your card details.
- Renewal. The subscription renews automatically every month until you cancel it.
- Cancelling. You can cancel at any time at my.roku.com (Subscriptions), or on your Roku home screen by highlighting KAVODA TV, pressing the * button and choosing Manage subscription. Cancellation takes effect at the end of the period you have already paid for; you keep ad-free viewing until then. There is no partial refund for the rest of that period except where Roku’s policy or the law provides one.
- Your 14-day right to cancel (UK consumers). If you buy KAVODA Plus as a consumer in the United Kingdom, you have the legal right to cancel within 14 days of purchase. Because the subscription starts straight away at your request, you may be charged for the days you had access before you cancelled. To use this right, cancel through Roku within the 14 days and, if you need help, email support@kavoda.tv.
- Price changes. If we change the price, we will give you at least 30 days’ notice by email or in the app before it applies to you. If you do not want to pay the new price, cancel before it takes effect.
- Where it works. Ad-free viewing is linked to the KAVODA account you were signed into when you bought it, on the Roku account that paid for it. Sharing or reselling a subscription is not allowed.
- Payment problems. If Roku cannot take a payment, your subscription may be paused and ad breaks will return until it is resolved.
- Trials and offers. If we offer a free trial or promotion, its terms are shown when it is offered and apply alongside these terms.
7. Using the content
The series, episodes, trailers, artwork, subtitles, audio tracks and everything else you can watch or see on the Service (“the content”) belong to KAVODA or to the studios and distributors who license it to us. It is protected by copyright and other laws.
While you follow these terms, we give you a limited, personal, non-commercial, non-exclusive, non-transferable and revocable licence to stream the content through the app on supported devices in the United States and the United Kingdom. That is all. In particular you must not:
- copy, download, record, screen-capture, store or redistribute the content, or make it available to anyone else, other than through features we provide;
- show the content publicly or commercially (for example in a bar, shop, waiting room or event) without our written permission;
- get around, disable or interfere with the encryption, digital rights management, access controls, age restrictions or territory restrictions on the content or the Service, including by using a VPN or proxy;
- use bots, scrapers, crawlers or other automated means to access the Service or the systems behind it, or access them by any means other than the app and pages we provide;
- reverse engineer, decompile or disassemble any part of the Service, except to the extent the law expressly allows despite this clause;
- remove or alter any copyright, trademark or other notice.
Content comes and goes. Our catalogue depends on licences, and titles can be added, changed or removed at any time. We do not promise that any particular series or episode will remain available, or that it will be available in a particular language, quality or resolution. Subtitles, captions and alternative audio tracks are provided for your convenience and may contain errors.
8. Rules of use
When you use the Service you must not:
- break the law, or encourage anyone else to;
- interfere with the operation or security of the Service, overload it, or try to gain access to accounts, systems or data that are not yours;
- share your sign-in details, or let anyone under 13 use the Service;
- misrepresent your age or location to see content you are not permitted to see;
- abuse, harass or deceive our staff or other viewers, including through our support channels;
- use the Service for any commercial purpose without our written agreement.
We may investigate suspected breaches and take whatever action we consider appropriate, including removing access, closing accounts, and reporting unlawful activity to the authorities.
9. Our intellectual property and your feedback
The names KAVODA and KAVODA TV, our logos, the app, its software and design, and the text, images and video we create are owned by KAVODA or our licensors. These terms give you no rights in any of them beyond the licence in section 7.
If you send us ideas, suggestions or feedback about the Service, you agree that we may use them freely, without payment or any obligation to you, and without it creating any confidentiality or other relationship between us.
10. Changes to the Service and to these terms
The Service. We may add, change or remove features, content, supported devices, the number of free episodes in a series, and the frequency of ad breaks. Maintenance and updates may interrupt the Service from time to time; we will try to keep interruptions short.
These terms. We may update these terms for legal, regulatory, security, product or business reasons. The new version will carry a new version number and effective date at the top. We will tell you by a notice in the app, by email, or both, and the app will ask you to accept the new terms where the change materially affects you. Using the Service after the effective date means you accept the new version. If you do not accept it, stop using the Service; you can delete your account at any time.
If a change to these terms or to the Service materially reduces what KAVODA Plus gives you, and you are a subscriber, you may cancel and we or Roku will refund the unused part of the period you have paid for.
11. Ending the agreement
By you. You can stop using the Service at any time, delete your account in the app, and cancel KAVODA Plus through Roku.
By us. We may suspend or end your access to the Service, immediately and without a refund, if you seriously or repeatedly break these terms, if we reasonably suspect fraud or unlawful use, or if the law requires it. We may also withdraw the Service altogether. If we do that, we will give you reasonable notice (at least 30 days where we can) and refund any unused part of a KAVODA Plus period you have paid for.
When the agreement ends, your licence to use the content ends. Sections that by their nature should continue — including sections 7, 9, 12, 13 and 16 — continue to apply.
12. What we promise, and the limits of our responsibility
What we promise. We will provide the Service with reasonable care and skill and as described in these terms. If we do not, you have the rights the law gives you — in the UK under the Consumer Rights Act 2015, and in the United States under the consumer protection laws of your state — and nothing in these terms reduces them.
What we do not promise. We do not promise that the Service will be uninterrupted or free of errors, that any particular title will be available, that it will be compatible with every device, firmware version or network, or that streaming quality will always be high. Streaming quality depends on your internet connection and your equipment, which we do not control.
What we are responsible for. If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result of that. We are not responsible for:
- loss that was not foreseeable to both of us when you accepted these terms;
- business losses — we provide the Service for private, domestic use only;
- loss caused by events outside our reasonable control, such as failures of Roku’s platform, your internet provider, our content licensors, or power and network outages;
- loss you could have avoided by following our reasonable instructions or keeping your account secure;
- damage to your device or data caused by something other than our Service, or by software you installed yourself.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.
Cap on liability. Subject to the paragraph above and to your statutory rights as a consumer, our total liability to you for all claims arising in any 12-month period is limited to the greater of: the amounts you paid for KAVODA Plus in that period, or £50 (US$50 if you live in the United States). If you use only the free tier, that means £50 / US$50.
If you live in the United States: to the fullest extent your state’s law allows, the Service and its content are provided “as is” and “as available”, and we disclaim implied warranties including merchantability, fitness for a particular purpose and non-infringement. Some states do not allow some of these exclusions or limits, in which case they apply to you only as far as that state’s law allows.
13. Your responsibility for misuse
If your breach of these terms, or your unlawful use of the Service, leads to a claim against us or causes us loss, you agree to compensate us for the reasonable costs and losses that result. This applies only to the extent the law allows, and never to ordinary, careful use of the Service as a consumer.
14. Copyright complaints
We respect the intellectual property of others and expect the same of everyone we work with. If you believe content on the Service infringes your copyright, send a notice to support@kavoda.tv with the subject “Copyright notice”, or by post to our registered office, including:
- a description of the copyrighted work you say has been infringed;
- where the material appears on the Service (series and episode) so we can find it;
- your name, postal address, telephone number and email address;
- a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;
- a statement, made under penalty of perjury where that applies, that the information in your notice is accurate and that you are the copyright owner or authorised to act for them;
- your physical or electronic signature.
This follows the United States Digital Millennium Copyright Act and the notice-and-takedown practice under the UK Copyright, Designs and Patents Act 1988. We will act promptly on valid notices, inform the licensor concerned, and consider any counter-notice they send. We end our relationship with licensors who repeatedly infringe.
15. Roku and other third parties
Your Roku device, the Roku Channel Store and Roku Pay are provided by Roku under Roku’s own terms and privacy policy, which apply alongside these terms. Roku is not a party to this agreement and is not responsible for the Service or its content. Roku’s own settings — for example limiting ad tracking — are described in the Privacy Policy.
The Service may link to or work with other third-party services. We are not responsible for them, and their terms apply to your use of them.
16. Which law applies and how disputes are handled
These terms, and any dispute or claim arising from them or from the Service, are governed by the law of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. That means:
- if you live in Scotland or Northern Ireland, you can also rely on the mandatory consumer protection rules of, and bring proceedings in, your home nation;
- if you live in the United States, nothing in these terms takes away the protection of the consumer laws of the state where you live, and you may bring a claim in your local courts where that law allows;
- if you live elsewhere in the European Union and use the Service there, you keep the protection of the mandatory consumer laws of your country.
Talk to us first. If something has gone wrong, email support@kavoda.tv. We aim to resolve complaints within 30 days. We are not obliged to use, and do not currently take part in, an alternative dispute resolution scheme.
17. Other things you should know
- The whole agreement. These terms, the Privacy Policy and any specific terms shown to you in the app (for example for an offer) are the whole agreement between you and us for the Service.
- If part of these terms is unenforceable, the rest still applies.
- If we delay enforcing these terms, we can still enforce them later.
- Transfer. We may transfer our rights and obligations under these terms to another organisation, for example if the business is sold; we will tell you if that happens. You may not transfer yours.
- Third parties. No one other than you and KAVODA has rights under these terms.
- Notices. We send notices to the email on your account or inside the app. You send notices to us at support@kavoda.tv or to our registered office.
- Language. These terms are written in English. If we provide a translation, the English version prevails.
